What we collect and why

For each use: the data, the reason, the legal basis (GDPR article 6) and how long we keep it.

• Measuring visits. Pages viewed, device type, approximate location and how you arrived, with Google Analytics, only if you accept Analytics cookies. Basis: your consent. Google Analytics keeps this data for at most 14 months.
• Advertising. The Meta pixel and the TikTok pixel let those platforms show our ads to you and measure them, only if you accept Marketing cookies. Basis: your consent.
• Chat and messages (site chat, email, Instagram, Messenger). Your name or username, contact details, public profile picture on Instagram or Facebook, your messages and their date and channel, to answer you and follow up. Basis: our legitimate interest in answering you. Kept 24 months after the last exchange.
• Contact form. Your name, email, subject and message, to answer you. Basis: our legitimate interest. Kept 24 months after the last exchange.
• Photos and video at the festival. Images of the crowd and of the night, to show and promote FCKNYE Festival. Basis: our legitimate interest. You can object (see Your rights).

Please don't send us health, bank or other sensitive details in the chat or by email unless we ask for them for your access needs.

Our AI assistant Eve

On the site chat, email, Instagram and Messenger, Eve answers first. Eve is an AI assistant that works from the festival's official information, 24 hours a day. When a request needs a person, especially for an order, a payment or access, our team takes over. Eve doesn't take decisions about you with legal or similar effects.

Who gets your data

Only our team members who need it, and the service providers below, under contract and on our instructions. We never sell or rent your data.

• OVH SAS (France): website hosting.
• Google Ireland Ltd: email inbox, forms, and, with your consent, Google Analytics and Google Tag Manager.
• Meta Platforms: messages you send us on Instagram or Messenger, and, with your consent, the Meta pixel.
• TikTok: with your consent, the TikTok pixel.
• TicketLive (Brussels Expo asbl): your ticket order, under its own privacy policy.
• Police, courts or other authorities, only when the law requires it.

Outside the EU

Some providers (Google, Meta, TikTok, and possibly our AI provider) may process data outside the European Union, for example in the United States. These transfers rely on an EU adequacy decision, such as the EU-US Data Privacy Framework, or on the European Commission's standard contractual clauses.

How long we keep it

We keep data only as long as needed for the reason we collected it, then delete or anonymise it. The periods are listed in each use above. Accounting records are kept as long as Belgian law requires.

Your rights

You can ask to see your data, correct it, delete it, limit its use, receive it in a reusable format, or object to its use. You can object to marketing at any time, and withdraw a consent at any time, without affecting what was done before.

Write to info@fcknyefestival.com. We answer within one month. We only ask for proof of identity if we can't be sure the request comes from you. For your ticket order, you can also write to TicketLive at privacy@brussels-expo.com.

Not happy with our answer? You can complain to the Belgian Data Protection Authority, Rue de la Presse 35, 1000 Brussels, contact@apd-gba.be, +32 2 274 48 00, dataprotectionauthority.be, or to the authority of the EU country where you live.

Age

FCKNYE Festival is open from age 16, and this site is meant for people aged 16 and over. If you're younger, please don't send us your data.

Changes to this policy

We update this policy when our tools or uses change. The date and version are at the top of the page, and we keep earlier versions. If a change affects something you agreed to, we'll ask you again.
